* Custody/Parental Rights

In Korea, custody is divided into parental rights (guardianship, the right to make decisions regarding a child’s status and property) and child-rearing rights (physical custody).
During marriage, both spouses can jointly exercise parental rights, but upon divorce, the designation of parental responsibilities becomes necessary. In the event of divorce, parents can designate custody and parental rights to one or both parents, or they may designate them separately. If custody and parental rights are designated separately, parental rights apply only to matters excluding physical custody
