* Prenuptial Agreement / registration of a matrimonial property agreement
In Korea, a prenuptial agreement does not function in the same manner as it does in other common law countries. Even if you draft a prenuptial agreement, the court will only consider it as a reference in the event of a divorce; it does not guarantee the property division as outlined in the agreement. However, we do have a system called “registration of a matrimonial property agreement.” A “marital property agreement” refers to an agreement made by the marrying parties before the establishment of their marriage, regarding the ownership and management of property during the marriage. If it is not registered before the marriage registration, it cannot be asserted against the successors of the spouses or third parties.
